Agreement to Terms of Use
These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and DM Dasher Pte Ltd (The Official Distributor of Mova Singapore), concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. Your trust is important to us, and we strive to be transparent in our practices.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms from time to time. We will alert you about any changes by updating the "Last updated" date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.
Intellectual property rights
All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Mova Singapore, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including "mirroring") to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Mova Singapore’s express prior written consent.
You may use information on Mova Singapore products and services (such as data sheets, knowledge base articles, and similar materials) purposely made available by Mova Singapore for downloading from the Site, provided that you (1) not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.
Your Use of the Site
You may not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. Mova Singapore reserves the right to take action to any such activity.
You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any Mova server, or to any of the services offered on or through the Site, by hacking, password "mining" or any other illegitimate means.
You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Mova Singapore, including any Mova Singapore account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Mova Singapore systems or networks, or any systems or networks connected to the Site or to Mova Singapore.
You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.
You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Mova Singapore on or through the Site or any service offered on or through the Site. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.
You may not use the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Mova Singapore or others.
Accounts, Passwords and Security
Certain features or services offered on or through the Site may require you to open an account. You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential.
You agree to notify Mova Singapore immediately of any unauthorized use of your account or password, or any other breach of security.You may be held liable for losses incurred by Mova Singapore or any other user of or visitor to the Site due to someone else using your account as a result of your failing to keep your account information secure and confidential.
You may not use anyone else’s account at any time without the express permission and consent of the holder of that Mova Singapore Account. Mova Singapore cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.
Privacy Policy
Mova Singapore's Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. Mova Singapore DOES NOT PROMISE THAT THE SITE OR ANY CONTENT, SERVICE OR FEATURE OF THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT YOUR USE OF THE SITE WILL PROVIDE SPECIFIC RESULTS. THE SITE AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. ALL INFORMATION PROVIDED ON THE SITE IS SUBJECT TO CHANGE WITHOUT NOTICE. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOVA SINGAPORE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES OR LOSSES OF ANY KIND IN ANY MANNER IN CONNECTION WITH OR ARISING OUT OF THIS TERMS, THE SITE, SERVICES OR CONTENT, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM OR WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS OR OPPORTUNITY, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES. IN THE EVENT THAT APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF WARRANTIES STATED HEREIN OR THE LIMITATION OF LIABILITY STATED HEREIN, THEN USERS EXPRESSLY AGREE THAT IN NO EVENT WILL MOVA SINGAPORE'S LIABILITY FOR ANY CLAIM OR DAMAGES HEREUNDER EXCEED THE AMOUNT PAID BY THE RELEVANT USER TO MOVA SINGAPORE IN RESPECT OF ANY PRODUCT OR SERVICE BEING THE SUBJECT OF THAT USER’S CLAIM.
Nothing in this Terms shall limit or exclude Mova Singapore's liability in respect of (i) losses caused by fraud or fraudulent misrepresentation, (ii) any other liability that cannot be excluded by law, or (iii) Users’ statutory rights.
Indemnity
You agree to indemnify and hold Mova Singapore, its officers, directors, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against Mova Singapore by any third party due to or arising out of or in connection with your use of the Site.
Violation of These Terms of Use
Mova Singapore may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Mova Singapore's rights or property, or the rights or property of visitors to or users of the Site, including Mova Singapore’s customers. Mova Singapore reserves the right at all times to disclose any information that Mova Singapore deems necessary to comply with any applicable law, regulation, legal process or governmental request. Mova Singapore also may disclose your information when Mova Singapore determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.
You acknowledge and agree that Mova Singapore may preserve any transmittal or communication by you with Mova Singapore through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or Mova Singapore determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Mova Singapore, its employees, users of or visitors to the Site, and the public.
You agree that Mova Singapore may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Mova Singapore, for which monetary damages would be inadequate, and you consent to Mova Singapore obtaining any injunctive or equitable relief that Mova Singapore deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies Mova Singapore may have at law or in equity.
You agree that Mova Singapore may, in its sole discretion and without prior notice, terminate your access to the Site, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Site or any service offered on or through the Site, or (4) unexpected technical issues or problems.
If Mova Singapore does take any legal action against you as a result of your violation of these Terms of Use, Mova Singapore will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Mova Singapore. You agree that Mova Singapore will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.
Products
Mova Singapore reserves the right to temporarily or permanently remove any product and/or service from the Site at any time without notice to Users.
All products sold through the Site are intended for domestic use and not commercial or industrial use unless otherwise stated. Commercial or industrial use of the products may cause the applicable product warranties to become void.
Product prices shown on the Site are quoted in Singapore Dollar (SGD) and are for merchandise only unless otherwise stated. Please proceed to checkout to review the total cost of order, including any applicable tax, delivery or other fees.
Pictures and images on the Site are for illustration purposes only. For an accurate description and specification of any product, please read the product pages carefully. When browsing the Site, the colours of products may vary depending on a number of factors, such as the display settings of Users’ computer monitor.
While Mova Singapore strives for accuracy in the pricing and other product information displayed on the Site, inadvertent errors can occur. In cases where such errors do occur, Mova Singapore expressly reserves the right not to honor pricing errors on the Site when accepting an order online. In the case where an order placed online contains a pricing error, Users will be contacted and the order will be cancelled. Any payments that have been authorised for that order will be reversed. Should a User discover an error or is not satisfied with a product once an order is delivered, his/her sole recourse is to return such order in accordance with Mova Singapore's return policy.
Mova Singapore's products come with a warranty, the terms and conditions of which can be found here. Warranty shall be void if the merchandise suffers damage caused by abuse, negligence or accident, has been relocated, repaired or tampered with, was sold on an "as is" basis, is used for commercial purposes or resold without Mova Singapore's consent in writing. Mova Singapore does not guarantee fabrics against wear, fading, color fastness or any damage caused by cleaning processes.
Mova Singapore reserves the right to adjust product and service prices (including delivery charges) and information at any time and in its sole discretion.
Promotional Offers, Discounts, Promo Code, etc
From time-to-time Mova Singapore may run promotions, contests, surveys, privileges and other programmes (collectively, “Promotions”), subject to additional terms and conditions which can be found on the Site and are hereby incorporated by reference into this Terms. Promotions are only valid for such time period as Mova Singapore may determine in its sole discretion.
Unless otherwise specifically provided, The following terms shall apply to the use of credits, vouchers, coupons and codes (collectively, “Promo Codes”):
Each Promo Code is only eligible for a single use and is only valid for the time period as specified by Mova Singapore;
Promo Codes are not resellable, transferable, exchangeable, convertible or redeemable for cash;
Promo Codes may not be combined or accumulated with other offers or promo codes;
Promo Codes may only be used pursuant to the specific terms that Mova Singapore establishes for such Promo Codes and Users must enter the relevant Promo Code into the relevant field prior to completing an order;
No reproduction, alteration, adaptation, tampering, distribution, publication, broadcast or other communication or dissemination of Promo Codes is allowed. Promo Codes are non-replaceable if lost, stolen, destroyed, duplicated, tampered with or otherwise misappropriated or fraudulently used. Mova Singapore reserves the right to verify the validity of any Promo Code and to declare null and void, any Promo Code which in its opinion has been stolen, duplicated, tampered with, or which is suspected to have been misappropriated or fraudulently obtained or used;
Mova Singapore reserves the right to withhold, deduct or remove credits or other features or benefits obtained through the use of a Promo Code by any User in the event that Mova Singapore determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal or in violation of the applicable terms and conditions of the Promo Code or this Terms.
Where any free gift is offered as part of a Promotion, the free gift is offered on a “first come first serve” basis and while stocks last basis. No cash will be offered in lieu of the gift.
Mova Singapore's decision on all matters relating to Promotions and Promo Codes is final and binding.
Mova Singapore reserves the right to change, suspend, cancel and/or waive any Promotion or Promo Code and its applicable terms and conditions thereof at any time and from time to time in its sole discretion without notice to Users and liability to Mova Singapore.
Payments
Users must provide Mova Singapore with a current, valid and accepted Payment Method to use the Services. This does not waive Mova Singapore's right to seek payment directly from Users through any other methods, should the Payment Method fails. The terms of a User’s payment will be based on his/her Payment Method and determined by agreement with the relevant financial institution, credit/debit card issuer or other provider of the selected Payment Method. Mova Singapore disclaims all liabilities associated with the security of the selected Payment Method. Users shall be responsible to resolve any disputes with their financial institution, credit/debit card issuer or other provider of the selected Payment Method.
All prices, fees and charges in respect of Mova Singapore's products or Services shall be subject to all prevailing statutory taxes, duties, fees, charges and/or costs, however denominated, as may be in force and in connection with any future taxes that may be introduced at any point of time.
All payments by Users in respect of Mova Singapore's products or Services shall be paid without set-off or counterclaim and free and clear of and without deduction or withholding for or on account of any taxes, levies, imposts, duties, fees, assessments or other charges of whatever nature, imposed by any governmental authorities, and all interest, penalties or similar liabilities with respect thereto.
Law and Dispute Resolution
Irrespective of the country from which Users access or use the Site and/or Services, to the extent permitted by law, this Terms and Users’ use of the Site and/or Services shall be governed in accordance with the laws of Singapore without regard to choice or conflicts of law principles, and Users hereby agree to submit to the exclusive jurisdiction of the courts of Singapore to resolve any claims or disputes which may arise in connection with this Terms.
